Hospital Medical Staff Bylaws

bigstock-MEdical-18229610Hospital Medical Staff Bylaws are the key documents for the self-governance of a medical staff. State law governs the relationship between physicians and hospitals and in Florida the bylaws have been interpreted as a contract between physician and hospital which includes vital due process rights

Qualified and experienced counsel is recommended for the medical staff when hospitals suggest changes to the by-laws. Likewise essential  is representing individual physicians when those due process rights are exercised typically when the hospital attempts to curtail, diminish, restrict or revoke medical staff privileges.

Hospitals will always have legal counsel and the affected physician must be represented. At stake is the physician’s ability to continue to practice.
